Despite the fact that Osama bin Laden continues to elude U.S. military forces in Afghanistan, the terrorist has been named as a defendant in several wrongful death lawsuits filed in the wake of the September 11th attacks. However, until recently, victims and their attorneys were faced with an interesting quandary. How to serve a complaint to a defendant who cannot be found?
Fortunately, late last month plaintiffs received encouraging news when District Judge Harold Baer ruled that lawsuits filed against bin Laden could be served through the media. As a result of the ruling, several Afghan and Pakistani newspapers, as well as Qatar's Al-Jazeera television network, can now be used as a substitute means of service. In addition to bin Laden, entities such as the Taliban, al Qaeda, and the Islamic Emirate of Afghanistan have been named as defendants in numerous civil proceedings.
