An Illinois jury awarded $12.5 million last week to a retired orthopedic surgeon who was left paralyzed from the waist down while undergoing surgery. Dr. James York was admitted to Rush-Presbyterian-St. Luke's Medical Center in 1998 for routine knee surgery. During the procedure, the attending anesthesiologist mistakenly injected an anesthetic into York's spine. York was left paralyzed below his belly button, although he would eventually regain control of his left leg. Plaintiff attorneys argued that York could no longer travel on missionary trips to Third World countries or participate in his many extracurricular interests, which included running marathons and tennis.
