A Missouri man severely injured in an automobile accident two years ago will receive $3.9 million as part of a settlement reached with the state's Department of Transportation. In 2000, Gary Nettell, a passenger in a Missouri Department of Transportation truck, suffered permanent injuries when driver Jerry Russell blacked out and drove his truck into another vehicle. While Missouri's sovereign immunity cap prevents an individual from collecting more than $316,000 when suing the state, plaintiff attorneys for Nettell argued that because Russell was a state employee the cap did not apply.
The truck wreck settlement was reached in September but was only made public recently.
